This article studies the specific area of general contracting conditions (i.e. non-individually negotiated terms in agreements) in mortgage loan agreements. More particularly, it studies the case dealt with in the ruling issued by the Spanish Supreme Court, dated 9 May 2013, which has recently been challenged by the interpretation of article 6(1) of Directive 93/13 made by the EUCJ.
